Terms and conditions of sale

Please read this document carefully as it contains the terms and conditions of sale which you are obliged to comply with when using the ELVEN MX online store. The terms and conditions indicated below (the “Conditions”) will apply to your use of ELVEN MX. and all purchases you make through ELVEN MX.

Purchase of ELVEN MX Products

Criteria for placing orders:

You can only buy products:

  • That are available for sale and whose details appear in ELVEN MX; with delivery in Mexico; and intended for personal use, either your own or that of the recipients for whom you purchase the products. ELVEN MX reserves the right to reject any order at its sole discretion (for example, when it considers that the order in question is intended to be subsequently sold through means other than distribution channels authorized by ELVEN MX).


The details of the products available for purchase (including their corresponding price) are specified in ELVEN MX. ELVEN MX will take all necessary and reasonable steps to ensure that all details, descriptions and prices of products appearing on ELVEN MX are correct when the information is included on ELVEN MX. Although we will use all means at our disposal to keep the ELVEN MX store as up to date as possible, the information specified at any given time may not always reflect the exact situation when you place an order.


Placing Purchase Orders for Products and Conclusion of the Purchase and Sale Contract:

  • Once you have selected the products you wish to purchase, these products will be included in the shopping cart.
  • At the end of the verification process, you will click on the “order summary” button to access the order summary page where you can identify and correct possible information errors.
  • At the bottom of the order summary page, you will need to click on the “submit order” button so that we receive a binding order.
  • Once you have clicked the “submit order” button, we will obtain an authorization from your credit or debit card company for the amount indicated on the order summary page. At this point in the process, we will not withdraw funds from your card, although the available balance on your card will be reduced with authorization. This process is the usual procedure followed by banks. If your credit card is not authorized, the order will not be processed.
  • ELVEN MX will send you an e-mail confirming receipt of your product order, which does not constitute an automatic acceptance by us of your order.
  • ELVEN MX will send you a second email accepting your order for products and confirming that the products you have ordered will be sent to you (“Shipping Confirmation”).
  • and ELVEN MX will have entered into a contract of sale of the products requested by you once we have sent you the Shipping Confirmation email and in any case, however, when you receive the aforementioned products.
  • The purchase and sale contract may be concluded in Spanish.

ELVEN MX may, at its sole discretion, refuse to process the order, or not be able to proceed with said processing, in the following cases, without any limitation:

  • When the product requested by you has stopped being manufactured or is not available;
  • When the marketing entity of your credit or debit card does not authorize payment of the purchase price;
  • When you do not meet the criteria for placing orders specified at the beginning of this section.


Delivery conditions

It is sent daily by Estafeta.

Shipping arrives in one to two business days within metropolitan areas.

In case of places far from the city, it could last up to 5 days.

Not all shipments arrive at home since there are locations that do not have this service and it happens.

In any case, the buyer will be informed of the shipping details.

Payment conditions

You can pay with your bank card (credit or debit card). The payment to your bank card will be made at the conclusion of the purchase and sale contract.
Payment by credit card is totally secure. The entire transaction is carried out in encrypted form through a bank validation server using the SSL (Secure Socket Layer) encryption protocol, so your credit card number and expiration date are instantly encrypted on your computer before being sent to the SSL protocol. No one will be able to use your data without your authorization, since the information is illegible. For greater security, this data is not stored on our server, so you must communicate all the information to us with each new order.

Returns and Order Cancellation

The conditions for the return and cancellation of the order indicated below will apply without prejudice to the rights that legally assist you.


ORDER CANCELLATION

You may change your mind and cancel your order within fourteen (14) days of receiving the products. If you decide to cancel your order, we will refund:

  1. a) the full purchase price
  2. b) the costs related to the shipment of the products to your attention.

DAMAGED OR DEFECTIVE PRODUCTS AND INCORRECT DELIVERY

You may (i) exchange your products, or (ii) obtain a full refund if the products in your order are damaged or defective upon receipt, or if the products you receive are not those you originally ordered.

You can return your products, along with delivery documentation, by dropping them off or by mailing them. Please note that this documentation is necessary to benefit from the free return. Please note that stores may accept returns, but will not make exchanges for other products for products purchased through the website; but through our Customer Service you will be refunded the money for your return.

General disposition


ELVEN MX reserves the right to:

  • Modify or cancel, temporarily or permanently, the service provided through ELVEN MX (or any part of it) with or without notice. ELVEN MX will not be responsible to you or other third parties for such modification or cancellation; I
  • If, despite modifying the Terms and Conditions and/or the Delivery Conditions, you continue using the service provided through ELVEN MX (or any part of it) after said modification, it will be considered that you have given your consent to said change. . You will be responsible for checking the Terms regularly to determine if any changes have occurred. If you do not agree with any modification of the Terms and Conditions, you must immediately stop using the ELVEN MX service.
  • In the event that ELVEN MX modifies these Conditions, your order will be subject to the Conditions in force on the date and time in which you placed your order.

    In the event that any part of the Terms and Conditions is declared illegal or unenforceable, the affected provision will be considered eliminated, with the remaining provisions of the aforementioned Terms and Conditions remaining in full force.
